1. Welcome

1.1 Welcome to the Connect Transit Card Program. The Connect Card Program makes using public transit easier by allowing transit users to use a single fare card for multiple transit systems in the greater Sacramento Region. The Connect Card Program is a collaborative effort between the Sacramento Area Council of Governments (SACOG) and a consortium of Sacramento area transit agencies.

1.2 These Terms & Conditions are binding and constitute the Cardholder’s/User’s Agreement. Use of the Connect Card Program will constitute acceptance of the Agreement and the application of its terms to all activities associated with the Connect Card Program. Capitalized terms throughout the Agreement are defined in Section 2, Definitions, below. Please read these Terms & Conditions thoroughly and keep a copy for your records.

1.3 The use of any Connect Card, Connect Card Website, product, service, or information related to Connect Card is subject to all applicable federal, state, and local laws, regulations, ordinances, and codes. This includes, but is not limited to the Connect Transit Card Fare Resolution: Privacy Policy, participating Agencies’ fares, rates, fees, rules of conduct, safety guidelines, and other applicable provisions relating to public transit.

2. Definitions

2.1 “Agency” or “Agencies”: Any and all of the regional agencies, including without limitation, the Sacramento Area Council of Governments (SACOG), that are part of the partnership formed to plan, manage, operate, and accept the Connect Card Program as payment for transit services.

2.2 “Agreement”: The Connect Transit Card Terms & Conditions, which become accepted by and binding on the Cardholder/User through use of the Connect Card Program.

2.3 “Auto-load”: The action of automatically loading Cash Value or fare products to a Connect Card by following pre-authorized instructions and form of payment.

2.4 “Cash Value”: Balance of pre-paid transportation fare electronically loaded on the Connect Card.

2.5 “Cardholder”: A person to whom an individual Connect Card has been issued or a person making use of a Connect Card.

2.6 “Connect Card”: The smart card, equipped with a computer chip that stores pre-paid electronic transit fare(s) used to ride transit services in the greater Sacramento region.

2.7 “Connect Card Program” or “Program”: The Connect Transit Card Program, which encompasses all associated products, services, Features, information, infrastructure, websites, systems, facilities, and staff.

2.8 “Connect Card System” or “System”: The electronic data mainframe used for storing and managing Connect Card registration and account information and loading or debiting transit fare to and from Connect Cards.

2.9 “Connect Card Website” or “Website”: Any official Connect Transit Card website hosted by the Agencies for the purpose of administering and promoting the Connect Card Program. (See Connect Transit Card Fare Resolution: Privacy Policy for further details).

2.10 “Customer Service”: Representatives from each participating transit agency and SACOG that provides information or support to Connect Transit Card customers, including over the phone, in-person, via email, or other methods.

2.11 “Feature”: Any data, trademark, logo, slogan, image, text, video, graphic, icon, music, sound, article, database or similar service mark developed for the Connect Card Program.

2.11 “Load”: The action of transferring purchased transit fare from the System to the card.

2.12 “Reader”: The electronic device on buses and light rail platforms that reads and writes information to and from the Connect Card and transfers information to/from the System.

2.13 “Registered Connect Card”: A Connect Card associated with a specific Cardholder through an optional registration process on the Connect Card Website, or with a Customer Service Representative in-person or over the phone.

2.14 “Retailer”: An establishment that, under agreement with the Agencies, distributes Connect Cards and loads fares and Cash Value.

2.16 “Unregistered Connect Card”: A Connect Card that is not registered to a specific Cardholder.

2.17 “User”: Any person interacting on the Connect Card Website.

3. Connect Card

3.1 All Connect Cards are the property of SACOG and are licensed to Cardholders. The Connect Cards are subject to these Terms & Conditions of use, and the license to a Cardholder may be cancelled if the conditions of use are not met.

3.2 The Connect Card is a plastic card that contains sensitive electronics and must not be bent, perforated, cut, punched, laundered, mutilated, or subject to extreme temperatures. Damage to the Connect Card can render the Connect Card inoperable, disqualify the Connect Card from use, subject the Connect Card to being surrendered, or disqualify the Cardholder from participation in the Connect Card Program. A card replacement fee may apply.

3.3 When a Cardholder uses a Connect Card at any Connect Card Reader, the Cardholder is authorizing the debit of the Connect Card Cash Value for the specific charges incurred per use (unless a valid/current pass product is available).

3.4 The Cash Value on a Connect Card is only redeemable for transit service through a participating Agency. Unused trips or unused Cash Value cannot be refunded or used to purchase other products, except where required by law.

3.5 The electronic record in the Connect Card System shall be conclusive evidence of the Connect Card Cash Value that remains unused or unexpired.

3.6 Information related to the Connect Card’s use is associated with the Connect Card’s Chip Number and associated Card Number and Security Code. Chip Numbers are encoded onto the internal computer chip, and Card Numbers and Security Codes are printed on the Connect Card.

3.7 The Cardholder/User acknowledges that personal and other information may be collected through the use of the Connect Card. Regardless of method of payment, the following information may be collected: the date/time, serial number, amount of Cash Value or type of pass purchased, the method of payment, or location of transaction

3.8 Cardholder/User authorizes the Agencies to use Cardholder’s/User’s information to contact Cardholder/User if there is a problem processing an order or transaction.

3.9 If upon boarding, the Cash Value is insufficient to cover the required fare, the Cardholder is required to make full fare payment by other means.

3.10 One card can be used to pay for two or more people travelling together. Additional riders paying a discounted fare must provide proof of eligibility for the discounted fare category (e.g. Medicare card). The Connect Card can be charged for the fare of each of the additional riders by informing the driver on a bus or pushing the appropriate buttons on a rail platform Reader.

3.11 Sales of a Connect Card and related fare are final and nonrefundable except as provided hereinafter. A refund in the form of a check may only be made in the event of a Cardholder’s death, military transfer, or as otherwise required by law.

3.12 Standard Connect Cards are reloadable and re-usable and can be used as long as the Connect Card Program is active. The Connect Card system has a default expiration date of 10 years from issuance of standard cards (may change without notice) and in the case that a standard card expires, it can be reactivated at any Customer Service Center. Discount Cards expire according to the policies at the applicable transit agency. When a Discount Card expires, the customer needs to take the Connect Card to a Customer Service Center and provide proof of eligibility to reactivate their Connect Card.

3.13 The Connect Card will become dormant after 24 months of non-use and can be reactivated by Customer Service. The Agencies reserve the right to terminate the Connect Card Program at any time.

3.14 Cardholders who qualify for participation in a discounted fare category must go to an Agency Customer Service Center to verify their eligibility for the discounted fare. If they qualify they will have a photograph printed onto their Connect Card. The Connect Card must be shown to the operator upon boarding the bus or van and fare inspector aboard light rail. An expiration date may be printed on the card. This expiration date signifies the end of the eligibility for discounted fares.

3.15 Connect Cards are currently provided free of charge for the initial roll out period of the program, provided the Cardholder loads minimum of $5 cash value or a transit pass onto the card. Replacement cards will be charged a fee and may vary by Agency. The Agencies reserve the right to charge a fee for issuance of a new or replacement card.

4. Authorized Connect Cards

4.1 Only authorized Connect Cards are permitted for use within the Connect Card Program. Only authorized Retailers may provide authorized Connect Cards. Unregistered Connect Cards are freely transferable (cards not associated with an account). If a Cardholder wants to transfer their Registered Connect Card to another person, they should unregister the card using the Connect Card Website or by calling the Connect Card Call Center. This will allow the new Cardholder to register the card if they choose.

4.2 A person or persons may not tamper with, deface, alter, duplicate, manufacture or otherwise create a counterfeit Connect Card. A Cardholder may not use a manipulated, defaced, altered, duplicated, or counterfeit Connect Card. A person or persons may not load a Connect Card through improper or unauthorized means. Improper or unauthorized loading of a Connect Card renders the Connect Card as unauthorized and the Agencies may pursue legal action against any individual engaged in such activity.

4.3 Agencies reserve the right to examine Connect Cards, confiscate Connect Cards suspected to be unauthorized, or deny transportation services to a Cardholder using or attempting to use an unauthorized Connect Card. Connect Cards must be surrendered by a Cardholder upon request by any Agency, as further outlined in Section 12, Reservation of Rights.

4.4 Sale of a fraudulent Connect Card is illegal and subject to prosecution under the California Penal Code and other applicable law.

5. Related Connect Card Program Acknowledgements

5.1 When personal information is required, Cardholder/User agrees to provide true, accurate, and complete information. Cardholder/User acknowledges that this information is given voluntarily and that he/she may decline to provide the information by not participating in the Connect Card Program.

5.2 Cardholder acknowledges that fares and Cash Value loaded to a Connect Card by mail or via the Connect Card Website are not instantaneous. The Connect Card System may need up to 48 hours to make the fare and Cash Value available at all Readers.

6. Connect Card Registration

6.1 Cardholders/Users may choose to participate in the Connect Card Program without providing any personal information. If a Cardholder chooses to register a Connect Card, it will be linked to the Cardholder’s information via a Connect Card account.

6.2 It is the Cardholder’s/User’s responsibility to update or remove information associated with their account.

6.3 Cardholders/Users should not disclose authentication information to any third party and should notify a Connect Card representative of any unauthorized use of their information.

6.4 A Cardholder of a Registered Connect Card may: a. Load transit fare online b. Access information (check card balance, transaction history, order history, online account management) c. Report a Connect Card as lost, stolen, or damaged and have remaining balance transferred to new Connect Card (replacement fee may apply) d. Establish Auto-load with a linked credit card

7. Lost, Stolen, Damaged, or Defective Cards

7.1 The Cardholder bears the risk of loss, theft, and damage. The Agencies reserve the right to charge a fee for replacement of a Connect Card, and to revise such fees.

7.2 Registered Connect Cards can be remotely deactivated and the remaining Cash Value may be transferred to a new Connect Card, subject to any replacement fees. There is a 48 hour waiting period between when a card is reported lost, stolen, or damaged before the remaining Cash Value can be transferred onto a new Connect Card; pass products can be replaced without a waiting period. If a card is lost or stolen, the Cardholder should report it immediately by using the Connect Card Website or calling the Connect Card Customer Service and Sales Center.

7.3 Cardholders acknowledge that Unregistered Connect Cards cannot be replaced and any Cash Value or pass products will be forfeited.

7.4 A Connect Card can be considered defective if a Connect Card Reader is unable to read the card. If an activated Connect Card is defective through no fault of the Cardholder, the Connect Card can be replaced to the Cardholder, without being subject to a replacement fee, and the remaining Cash Value and/or pass products will be transferred to a new Connect Card. This can be accomplished in person at a Connect Card Customer Service and Sales Center or by mailing the Connect Card to the Connect Card Customer Service and Sales Center with a letter explaining the issue and the mailing address that the Cardholder wishes to have the replacement card sent to.

8. Sale of Connect Cards and Retailers

8.1 The method of acceptable payment varies by location of sale. The Agencies reserve the right to change forms of payment accepted at any time without notice.

8.2 A Retailer must be an approved retail business or entity that, under agreement with the Agencies, distributes Connect Cards and/or is equipped with a device at which a Cardholder may purchase fares to load onto a Connect Card.

8.3 A Retailer determines which forms of payment will be accepted by Retailer, in addition to cash. Cardholder/User acknowledges that the agencies are not responsible for which methods of payment are accepted by Retailers.

8.4 Sales of Connect Cards or associated Connect Card products at a Retailer are not subject to refunds by the Agencies.

8.5 The Retailer is responsible for the collection, storage, transmittal, safekeeping, and use of payments and information that a Cardholder or User may provide to the Retailer in connection with the Connect Card Program. The Agencies are not responsible for actions of a Retailer.

8.6 A Retailer is not able to remotely deactivate lost, stolen, damaged, or defective cards.

9. Connect Card Website

9.1 The Connect Card Website is offered to the User, conditioned on acceptance of these Terms & Conditions. User access and/or use of the Connect Card Website constitutes acceptance of these Terms & Conditions. User access and/or use of the Connect Card Website also constitutes acknowledgment and acceptance of the Connect Transit Card Fare Resolution: Privacy Policy.

9.2 Cardholder/User acknowledges that Connect Card Program staff or administrators may provide evidence of possible criminal activity to appropriate law enforcement officials, upon proper legal request.

9.3 Cardholder/User acknowledges that certain information is automatically gathered and stored through the use of the Connect Card Website, which includes but is not limited to: a. Internet domain b. Internet Protocol (IP) address c. Type of browser d. Type of operating system e. Date and time of access f. Pages visited g. Links from other websites h. Links clicked on

9.4 Information on the Connect Card Website may change without notice.

9.5 Errors in information in print or electronic form may occur. The Agencies disclaim responsibility for any inaccuracy of the information contained within the Connect Card Website or any printed materials associated with the Connect Card Program.

9.6 The Connect Card Website may have links to other websites. When User links to an external website, these Terms & Conditions no longer apply. Instead, User is subject to any and all privacy notice and other terms of that external website, if any.

9.7 The Agencies are not responsible for any links or pointers to third party Internet websites contained within the Connect Card Website. The Agencies do not assume any responsibility or liability for any information, communications, images, or any similar materials available at such linked websites. Additionally, the Agencies do not intend for these links to be endorsements or referral to the linked entities, and are provided for convenience and educational purposes only. It is the User’s responsibility to view any and all policies associated with the third party Internet websites, if any.

9.8 If a User creates or is issued a password in connection with the Connect Card Website, it is the User’s responsibility to keep the logon and password private. The Agencies are not responsible for any logon or password information that is disseminated to any individual that has not been authorized to use such information on a User’s behalf.

9.9 Viewing, printing, and/or downloading of any content from the Connect Card Website grants the User only a limited, nonexclusive, revocable license for use solely by the User’s personal use and not for republication, distribution, assignment, sublicense, transfer, sale, preparation of derivative works, or other non-personal use.

9.10 To the extent that the Connect Card Website contains or may in the future contain a discussion board or other form of interactive communication forum, the User agrees only to send and receive messages and material that are proper and related to the forum. User shall not make a misrepresentation of fact in connection with the Connect Card Program. User is prohibited from posting or sending any defamatory, infringing, obscene, false, or unlawful material.

9.11 No portion of any content, graphic, or document may be reproduced in any form other than for User’s personal use. Except for the limited rights expressly granted herein, all right, title, and interest in and to the Connect Card Website and any and all materials therein are retained and owned by the Agencies. The User’s right to access Connect Card Website may be revoked at any time by Agencies.

9.12 By using the Connect Card Website, the User assumes all risks associated with the use of the Internet and the Website, including any risk to User’s computer, software, or data. Damage may occur through various means, including, but not limited to virus, software, or other harmful files, which may be transmitted or activated via the Connect Card Website.

10. Proof of Payment, Fares, & Disputes

10.1 The Connect Card Program requires fare payment prior to boarding a vehicle and may require a Cardholder to present proof of payment while on board. Proof of payment shall be established by electronically querying the card to view the most recent transactions.

10.2 Failure to tap a Connect Card to deduct the appropriate transportation fare is considered a non-payment of fare.

10.3 The maximum Cash Value a Connect Card may have loaded is $360.00; this amount is subject to change.

10.4 If at any time the Connect Card Reader or Website fails to accurately display the remaining balance on the Connect Card, immediately contact the Connect Card Customer Service and Sales Center.

10.5 Cardholder/User authorizes the Agencies to decide in the first instance every question or dispute arising from, in connection with, or related to the use of the Connect Card Program. This includes, without limitation, questions or disputes regarding the imposition of fares, fees, or other charges associated with the use or misuse of the Connect Card Program.

10.6 All disputes asserted by a Cardholder/User must be submitted in writing within 14 days of the date of the dispute (i.e. transit boarding, pass purchase, etc) to the address provided in Section 21. Disputes shall include the Cardholder contact information and card number along with the details of the dispute. The dispute will be reviewed and a decision made by the Connect Card Customer Service and Sales Center. Decisions made by the Connect Card Customer Service and Sales Center are final.

11. Information Security

11.1 Except as otherwise provided by law the Agencies intend to use and share all information collected through or generated by the Connect Card Program for the purposes of fare media sales, fare collection, monitoring the performance of the Connect Card Program, soliciting and receiving feedback, making further developments to the Connect Card Program, generating reports, analyzing trip behavior, and for any other Connect Card Program or Agency purpose or purposes, as set forth in the Connect Transit Card Privacy Policy.

12. Other Reservation of Rights

12.1 The Agencies reserve the right to: a. Inspect and retain a Cardholder’s Connect Card; b. Suspend or cancel any Connect Card; c. Change fares and/or fees at any time; d. Terminate or modify these Terms & Conditions or the Connect Transit Card Fare Resolution: Privacy Policy at any time, without advance notice. e. Terminate the Connect Card Program at any time f. Recover any and all costs, expenses, losses, and/or damages incurred as a result of the Cardholder/User altering or interfering with any aspect of the Connect Card Program; g. Recover all costs, including but not limited to attorney’s fees, incurred by an Agency or Agencies to collect any monies due under this Agreement; and h. Modify the list of transit Agencies that accept the Connect Card as a valid form of payment.

13. No Warranties

13.1 PROCEDURES AND MEASURES BELIEVED TO BE COMMERCIALLY REASONABLE TO PROTECT ANY INFORMATION COLLECTED FOR THE CONNECT CARD PROGRAM HAVE BEEN ADOPTED. HOWEVER, THE AGENCIES DO NOT GUARANTEE INFORMATION SECURITY OR WARRANT THAT THE INFORMATION COLLECTED WILL REMAIN FREE FROM UNAUTHORIZED ACCESS AND THE AGENCIES EXPRESSLY DISCLAIM ANY SUCH OBLIGATION. FURTHERMORE, AGENCIES MAKE NO GUARANTEES AS TO THE ACCURACY OF ANY POSTED OR DISSEMINATED INFORMATION REGARDING THE CONNECT CARD PROGRAM.

14. Disclaimer of Liability and Reliability

14.1 Errors may occur within the Connect Card Program. The Agencies do not assume any responsibility or liability for errors, inaccuracies, or problems within the Connect Card Program. User/Cardholder assumes all risk associated with the use of the Connect Card Program.

14.2 To the extent provided by law, the Agencies disclaim all warranties and duties of every kind, express, implied, or statutory, including but not limited to any implied warranties of merchantability or fitness for a particular purpose or created by trade usage, course of dealing or course of performance. The Agencies make no warranties or representations whatsoever regarding the quality, content, completeness, suitability, adequacy, accuracy, or timeliness of any and all information and service related to the Connect Card Program. By way of example and not limitation, the Agencies disclaim any warranty and does not represent or warrant that the elements of the Connect Card Program will be uninterrupted, timely, secure, or free from error.

14.3 CONNECT CARD INFORMATION AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” “WITH ALL FAULTS,” AND WITHOUT WARRANTIES OF ANY KIND. THE AGENCIES MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDITION OR FUNCTIONALITY OF THE CONNECT CARD PROGRAM, INCLUDING BUT NOT LIMITED TO CONNECT CARDS, THE CONNECT CARD WEBSITE, CONNECT CARD READERS ON BUS AND LIGHT RAIL, ADD FARE MACHINES, RETAIL SALES DEVICES, HAND-HELD FARE INSPECTION DEVICES, CONNECT CARD PROGRAM STAFF, CONNECT CARD SYSTEM, ASSOCIATED PRODUCTS, MATERIAL AVAILABLE FOR DOWNLOAD, OR FURTHER MATERIAL OTHERWISE AVAILABLE THROUGH THE USE OF THE CONNECT CARD WEBSITE. USE OF THE CONNECT CARD PROGRAM IS DONE AT THE CARDHOLDER’S/USER’S OWN RISK.

14.4 Cardholder/User acknowledges that no joint venture, partnership, employment or agency relationship exists between the Cardholder/User and any of the Agencies as a result of this Agreement or use of the Connect Card Program. Cardholder/User agrees not to hold himself or herself out as a representative, agent, or employee of the Agencies and the Agencies shall not be liable for any representation, act or omission of the Cardholder/User.

14.5 Cardholder/User acknowledges and agrees that third party entities that store information regarding the Connect Card Program are solely responsible for the security of the information they retain.

15. Disclaimer of Damages

15.1 Cardholder/User assumes all risks associated with the use of the Connect Card Program. The Agencies shall not be liable for any loss or injury caused in whole, or in part, by its actions, omissions, or contingencies beyond their control, including in procuring, compiling, or delivering of information, or action taken or not taken in reliance upon information furnished or service provided.

15.2 THE AGENCIES SHALL NOT IN ANY EVENT BE LIABLE FOR ANY FORM OF DAMAGES, INCLUDING THOSE THAT ARE SPECIAL, CONSEQUENTIAL, GENERAL, INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES, OR THOSE THAT ARE FOR LOSS OF USE, LOSS OF TIME, LOSS OF PROFITS, LOSS OF PRIVACY, LOSS OF DATA, LOSS OF GOODWILL, INCONVENIENCE, COMMERCIAL LOSS, LOSS OF ANTICIPATED SAVINGS, WASTED MANAGEMENT TIME OR LABOR, OR FAILURE TO MEET ANY DUTY, WHEN SUCH DAMAGES ARISE OUT OF OR ARE RELATED TO THE CONNECT CARD PROGRAM, EVEN IF ANYONE WITHIN THE AGENCIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IN THE EVENT OF A TORT OR VIOLATION OF CONTRACT OR POLICY.

15.3 IN THE EVENT AN AGENCY OR AGENCIES BREACH ANY DUTY OR AGREEMENT RELATING TO THE CONNECT CARD PROGRAM, THE EXCLUSIVE REMEDY WILL BE, AT THE OPTION OF THE AGENCY OR AGENCIES: (A) CORRECTION, SUBSTITUTION, OR REPLACEMENT OF ALL OR PART OF THE CONNECT CARD PROGRAM PRODUCTS OR SERVICES GIVING RISE TO THE BREACH, OR (B) A REFUND OF THE AMOUNT PAID FOR THE CONNECT CARD PRODUCT OR SERVICE CAUSING THE DAMAGE, WHICH AMOUNT WILL NOT EXCEED THE DAMAGES ACTUALLY INCURRED.

15.4 THE LIMITATIONS ON LIABILITY, DAMAGES, AND REMEDIES IN THESE TERMS, CONDITIONS, & PRIVACY POLICIES SHALL APPLY EVEN IN THE EVENT THAT A REMEDY FAILS FOR ITS ESSENTIAL PURPOSE.

16. Force Majeure

16.1 Agencies shall have no liability for damages or any failure to perform due to circumstances or causes that are, directly or indirectly, beyond its control. For purposes of this Agreement, Force Majeure shall mean a cause or event that is not reasonably foreseeable or otherwise caused by or under the control of the Agencies, including acts of God, fires, floods, explosions, riots, wars, hurricane, sabotage, terrorism, vandalism, accident, restraint of government, governmental acts, injunctions, labor strikes, and other like events that are beyond the reasonable anticipation and control of the Agencies.

17. Indemnity

17.1 As a condition of use of the Connect Card Program, the Cardholder/User agrees to hold harmless, defend, and indemnify the participating Agencies and their respective members, officers, directors, employees and agents, against any and all liability, expenses, and damages arising out of claims resulting from Cardholder’s/User’s use of the Connect Card Program, including, without limitation, any claims alleging facts that if true would constitute a breach by Cardholder/User of these Terms & Conditions.

18. Jurisdiction and Venue

18.1 The laws of the State of California shall govern all aspects of the Connect Card Program, including but not limited to this Agreement, the Connect Transit Card Privacy Policy, and all performances and claims of every nature (including without limitation, contract, tort, and strict liability) relating in any way to the Connect Card Program, without giving effect to any principles of conflicts of laws. Cardholder/User consents to the exclusive jurisdiction and venue of courts in Sacramento, California in all disputes arising out of or relating to the use of or participation in the Connect Card Program. Cardholder/User consents to the jurisdiction of a state or federal court in Sacramento, California; waives any claim or defense that such forum is not convenient or proper; and consents to service of process by any means authorized by California State or federal law.

19. Severability

19.1 If any part of this Agreement is determined to be invalid or unenforceable, then the unenforceable provision will be deemed superseded by a valid, enforceable provision. The invalidity of any term or terms of this Agreement shall not affect any other term of this Agreement, which shall remain in full force and effect.

20. Copyright and Trademarks

20.1 All Features and similar content relating to or provided through the Connect Card Program are the property of the Agencies. Nothing shall be construed as granting, by implication, estoppel or otherwise, any license or right to make commercial use of any Connect Card Features without prior written permission.

20.2 All Connect Card Features are the sole and exclusive property of the Agencies. Any copying or use not approved in writing by the Agencies is strictly prohibited and all rights are reserved.

20.3 All individuals and entities are prohibited from reproducing, modifying, distributing, transmitting, reverse engineering, decompiling, disassembling, re-posting, deep linking, republishing, framing, displaying, or otherwise using these Features for any purpose without the written permission of the Agencies. However, Cardholders/Users may print, make hard or electronic copies of the following: (a) Connect Transit Card Fare Ordinance: Terms & Conditions (b) Connect Transit Card Fare Resolution: Privacy Policy, and (c) fares, service locations, and other information solely for personal or employment purposes, but not for other commercial purposes.

20.4 The Agencies respect the intellectual property rights of others and requests that Cardholders and Users do the same. Anyone who believes his or her work has been reproduced through any portion of the Connect Card Program in a manner constituting copyright infringement may provide a notice to the Connect Card Customer Service and Sales Center.

22. Changes to these Terms & Conditions

22.1 These Terms & Conditions may be amended at any time. If changes occur, copies will be made available in print and on the Website for at least thirty (30) days before they become effective. An alert will be posted on the Website. A Cardholder/User signifies agreement with the changes when he/she uses any aspect of the Connect Card Program after the effective date. 23. Closing Provisions
